The Trump administration is seeking custody of Tina Peters, the former GOP Colorado election clerk who was sentenced to nine years in prison on state charges for her role in a 2021 voting system data breach, in a failed attempt to find voter fraud.
President Donald Trump threatened on social media to take “harsh measures” if Peters isn’t released, citing age and failing health as he called for her release
The 70-year-old is currently incarcerated at the La Vista Correctional Facility, a medium-security facility for women located in Pueblo.
In 2024, a state judge sentenced Peters to nine years in prison and jail after she was found guilty of several felonies stemming from her efforts to help a man gain unauthorized access to Mesa County’s Dominion voting machines in 2021.
Her attorney has asked a federal judge to expedite his ruling on Peters’ federal habeas corpus case and release her on bond immediately, citing her declining health.
on October 16, 2025, the Court stated that it would rule on Mrs. Peters’ Application ‘promptly,’ the Nov. 13 filing stated. “Since then, Mrs. Peters’ health has declined.”
The former GOP was convicted of three counts of attempting to influence a public servant, one count of conspiracy to commit criminal impersonation, one count of official misconduct and one count of failure to comply with the secretary of state, and sentenced to eight years, nine months of incarceration in October 2024 after improperly allowing an unauthorized person to enter a secure area of the Mesa County Elections Division in May 2021 to make copies of computer hard drives in search of election fraud, and misleading officials in the process.
